DecreeNo.16oftheMinistryofHumanResourcesandSocialSecurityofthePeople’sRepublicofChina InterimMeasuresforSocialInsuranceSystemCoverageofForeignersWorkingwithintheTerritoryofChina,whichwasdeliberatedandadoptedatthe67thexecutivemeetingoftheMinistryofHumanResourcesandSocialSecurityandapprovedbytheStateCouncil,isherebypromulgatedandshallcomeintoeffectasofOctober15,2011. YinWeimin,MinisterofHumanResourcesandSocialSecuritySeptember6,2011 InterimMeasuresforSocialInsuranceSystemCoverageofForeignersWorkingwithintheTerritoryofChina Article1 TheseMeasuresareformulatedpursuanttoSocialInsuranceLawofthePeople'sRepublicofChina(hereinafterreferredtoas“SocialInsuranceLaw”),withaviewtosecuringthelegitimaterightsandinterestsofforeignersworkingwithintheterritoryofChinatosocialinsuranceparticipationandbenefitsinaccordancewiththelaw,aswellasstrengtheningsocialinsuranceadministration. Article2 ForthepurposeoftheseMeasures,aforeignerworkingwithintheterritoryofChinashallrefertoanon-Chinesenationalwhoisinpossessionofanemploymentpermit,suchasEmploymentPermitforForeigners,ForeignExpertCertificate,orResidentForeignCorrespondent’sPressCard,andthePermanentResidencePermitofForeigners,andislawfullyworkingwithintheterritoryofthePeople’sRepublicofChina. Article3 Foreignerslawfullyrecruitedandemployedbyenterprises,publicinstitutions,socialorganizations,privately-runnon-enterpriseentities,foundations,lawfirms,accountingfirmsandotherorganizationsdulyregisteredwithintheterritoryofChina(hereinafterreferredtoasthe“employers”)shallparticipateinthebasicold-ageinsuranceforemployees,basicmedicalinsuranceforemployees,workinjuryinsurance,unemploymentinsuranceandmaternityinsuranceinaccordancewiththelaw,withtheemployersandthepersonsinquestionpayingsocialinsurancecontributionsasprescribed. Foreignerswho,afterhavingsignedlabourcontractswithoverseasemployers,aredispatchedtoworkintheirbranchesorrepresentativeofficesdulyregisteredwithintheterritoryofChina(hereinafterreferredtoasthe“hostserviceentities”)shallparticipateinthebasicold-ageinsuranceforemployees,basicmedicalinsuranceforemployees,workinjuryinsurance,unemploymentinsuranceandmaternityinsuranceinaccordancewiththelaw,withthehostserviceentitiesandthepersonsinquestionpayingsocialinsurancecontributionsasprescribed. Article4 Theemployerwhohiresforeignersshallprocesssocialinsuranceregistrationfortheforeignersrecruitedandemployedwithin30daysfromthedateofitsprocessingtheiremploymentpermits. Forforeignersdispatchedbytheiroverseasemployerstoworkathostserviceentities,thehostserviceentitiesshallprocesssocialinsuranceregistrationontheirbehalfinaccordancewiththeprecedingparagraph. TheagenciesprocessingemploymentpermitsforforeignersinaccordancewiththelawshallpasstheinformationrelatedtonewemploymentofforeignersinChinaontothelocalsocialinsuranceagenciesinatimelymanner.Thesocialinsuranceagenciesshallenquirerelevantagenciesofinformationregardingemploymentpermitsprocessedforforeignersonaregularbasis. Article5 Foreignerscoveredinthesocialinsurancesystemshallbeentitledtosocialinsurancebenefitsinaccordancewiththelawoncethequalifyingconditionsaremet. ForaforeignerwholeavesChinabeforereachingthestatutorypensionage,thesocialinsuranceindividualaccountshallberetained,andshallberenewedonacumulativebasiswhenthepersoninquestionreturnstoworkinChina.Alternatively,uponwrittenapplicationforclosingthesocialinsuranceaccountfromthepersoninquestion,theproceedsintheindividualaccountcanbepaidlump-sumtothesaidperson. Article6 Thebalanceinthesocialinsuranceindividualaccountofadeceasedforeignermaybeinheritedpursuanttothelaw. Article7 AforeignerwhoreceivesmonthlysocialinsurancebenefitsandresidesoutsidetheterritoryofChinashall,atleastonayearlybasis,submittothesocialinsuranceagencythatpaysthebenefitsadocumentoflivingproofissuedbytheChineseembassyorconsulate,oradocumentoflivingproofnotarizedorcertifiedbyanagencyoftheresidencecountryandrecognizedbytheChineseembassyorconsulate. AforeignerwhoislawfullyresidinginChinamaypresenthimorherinpersontothesocialinsuranceagencyasthelivingproofandisthusnolongerrequiredtoprovidethedocumentstipulatedintheprecedingparagraph. Article8 Ifadisputeoccursoversocialinsurancebetweenaforeignerlegallycoveredinthesocialinsurancesystemandhisorheremployerorhostserviceentity,thepersoninquestionmayapplyformediation,arbitration,orfilealawsuitinaccordancewiththelaw.Aforeignerwhosesocialinsurancerightsandinterestsareinfringeduponbyhisorheremployerorhostserviceentitymaydemandredressfromanadministrativeagencyofsocialinsuranceortheagencyresponsibleforcollectionofsocialinsurancecontributionsinaccordancewiththelaw. Article9 AforeignnationalworkingwithintheterritoryofChinafromastatewhichhassignedabilateralormultilateralsocialinsuranceagreementwithChinashallbegovernedbythesaidagreementwithregardtohisorhersocialinsuranceaffairs. Article10 Socialinsuranceoperatingagenciesshall,inaccordancewithRulesonCompilingSocialSecurityNumbersforForeigners,assignsocialsecuritynumbersandissuesocialsecuritycardsofthePeople'sRepublicofChinatoforeignerscoveredinthesystem. Article11 SocialinsuranceadministrativeagenciesshallexercisesupervisionandinspectionoverparticipationofforeignersinsocialinsurancesystemaccordingtotheprovisionsinSocialInsuranceLaw.Whereanemployerorhostserviceentityfailstoprocesssocialinsuranceregistrationorpaysocialinsurancecontributionsinaccordancewiththelawforaforeignerwhomitrecruitsandemploys,thecaseshallbeaddressedinaccordancewiththeprovisionsofSocialInsuranceLaw,RegulationsonLaborandSocialSecurityInspection,andotheradministrativeregulationsandrules. AnemployerrecruitingandemployingaforeignerwithoutalegallyobtainedemploymentpermitorthePermanentResidencePermitofForeignersshallbesubjectedtoRulesfortheAdministrationofEmploymentofForeignersinChina. Article12 TheseMeasuresshallcomeintoeffectonOctober15,2011. Attachment:RulesonCompilingSocialSecurityNumbersforForeigners RulesonCompilingSocialSecurityNumbersforForeigners Thesocialinsurancenumber(SSN)assignedtoaforeignercoveredinsocialinsurancesysteminChinashallbeacombinationoftheperson’shomecountryorareacodeandhisorhervalididentitydocumentnumber.ThevalididentitydocumentmeanseitherapassportoraPermanentResidencePermitofForeigners.Betweenthehomecountryorareacodeandtheidentitydocumentnumber,onedigitshallbereserved.ThecompositionoftheSSNisthusasfollows: XXX X XXXXXXXXXXXXXX（country/areacode） （reserveddigit）（valididentitydocumentnumber） 1．Aforeigner’shomecountryorareacodeshallfollowthestandardfromPart1:countrycodesofISO3166-1:2006Codesfortherepresentationofnamesofcountriesandtheirsubdivisions,andconsistofa3-lettercode.Forinstance,GermanyiscodedasDEU,DenmarkiscodedasDNK.Oncetheinternationalstandardisupgraded,MinistryofHumanResourcesandSocialSecuritywilldetermineadatefornationwideconcurrentcodeupgrading. ForaforeignerwhohassatisfiedqualificationsforpermanentresidenceinChina,thethree-lettercodeofhisorherhomecountryorareashallbeidenticaltothefirstthreelettersinthenumberofhisorherPermanentResidencePermit,whichservetorepresenthisorhercountryorareainthePermit. 2．OnedigitisreservedintheSSN.Number0isappliedbydefault,anditcanbeanumberbetween1and9underspecialcircumstances. 3．WhenavalidpassportnumberisincludedinaSSN,alltheEnglishalphabetsandArabicnumeralsinthepassportnumbershallberetained,whereasspecialsymbolslike“.”or“-”areexcluded.WhenthenumberofaPermanentResidencePermitofForeignersisincludedinaSSN,the4thtothe15thdigitsinthePermitshallberetained. (1)Example1:AmanofGermannationalityworksforanemployerinChinaandhispassportnumberisG01234—56,thenhisSSNshallbeDEU0G0123456.Countryorareacode reserveddigit validpassportnumber DEU 0 G0123456 (2)Example2:AwomenofDanishnationalityworksforanemployerinChinaandherPermanentResidencePermitofForeignersisDNK324578912056,thenherSSNshallbeDNK324578912056.Countryorareacode reserveddigit No.ofPermanentResidencePermitofForeignersDNK 0 324578912056 4．Thedatabasewillallowforamaximumof18digitsforaforeigner’sSSN,amongwhichamaximumof14digitsareallocatedtothevalidpassportnumber.IfaSSNislessthan18digits,theoriginalnumbershallstand. 5．TheSSNassignedtoaforeignerisuniqueandremainsunchangedforlifeinChina.Whenaforeignerchangeshisorheridentitydocumentnumber,theSSNassigneduponhisorherfirstregistrationwithsocialinsuranceagencyshallremainvalidandserveastheonlyidentification.Socialinsuranceagenciesshallkeeprecordsofthechangesoftheidentitydocumentsandtheirnumbersoftheforeignerscoveredinsocialinsurancesystem.
